This Privacy Policy applies to www.losteden.com (hereinafter, "us", "we", or "www.losteden.com"). We respect your privacy and are committed to protecting personally identifiable information you may provide us through the Website. We have adopted this privacy policy ("Privacy Policy") to explain what information may be collected on our Website, how we use this information, and under what circumstances we may disclose the information to third parties.

This Privacy Policy applies only to information we collect through the Website and does not apply to our collection of information from other sources. This Privacy Policy (losteden.com/privacy), together with the Terms and Conditions posted on our Website, set forth the general rules and policies governing your use of our Website. Depending on your activities when visiting our Website, you may be required to agree to additional terms and conditions.

1. What information is collected?

Information you give us.

You provide us with information about yourself when corresponding with us, entering our competitions, buying our wines, or when using or registering on our websites. This may include:
  • when you transact with us online, over the phone, or in person;
  • when you enter a promotion or competition conducted by us (including via our websites or through social media sites);
  • when you visit and/or register to use one of our websites or when you participate in discussion boards or other social media functions on our websites; or
  • when you contact us to request information or support in relation to our company, products, or services (including about our brands, shares in our company, product quality, visiting our sites, or employment opportunities).
If you buy wine from us online - for example, we will require you to provide us with your name, address, and phone number so we can process your order and deliver your wine to you. We will also require your date of birth to verify that you are of legal drinking age and your credit card number to process the sale.

Information collected by us and our use of cookies

To enrich and perfect your online experience, Lost Eden uses "Cookies," similar technologies and services provided by others to display personalized content, appropriate advertising, and store your preferences on your computer. We also utilize third-party services that use tracking technologies when you visit our site.
A cookie is a string of information that a website stores on a visitor's computer and that the visitor's browser provides to the website each time the visitor returns. Lost Eden uses cookies to help Lost Eden identify and track visitors, their usage of https://www.losteden.com, and their website access preferences. In many cases, such information will be collected directly from you, such as through a transaction or inquiry (including via a telephone call or SMS correspondence) or your submission of a form, registration or communication to us. Information may also be gathered from third-party sources (including without limitation, our third-party service providers (such as marketing and fulfillment companies), opt-in lists, publicly available data, consumer reporting agencies, other companies and referrals, and through your activities and interactions with us, including, without limitation, your online activity on our website. We may combine data collected from these disparate sources unless we tell you otherwise. Any of your personal data or other information gathered by one of our brands may be shared with and used by any of our other brands in accordance with this Privacy Policy. 

3. Why is information collected?

We use your personal data only for specific and limited purposes. We use the information described above to process your requests and wine club orders; communicate with you about our products, services, offers, and events; offer you products and services we believe may be of interest to you; analyze trends and enhance our communications strategies with you; and to improve the quality of our online guest services.
We may also use this information for system administration to diagnose problems with our servers and software or to administer our site. 

4. Security

We take appropriate measures to keep your personal information secure. We have implemented appropriate physical and electronic procedures to protect the personal information we collect. If you have an account with us, you are responsible for maintaining the confidentiality of your account details including your password and are responsible for any activity under your account. We will not be responsible for any loss arising from your failure to comply with this obligation.

Due to its nature, the transmission of information via the internet is not completely secure. Although we will protect your personal data in accordance with this policy, we cannot guarantee the security of any data transmitted to our websites and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security measures to try to prevent unauthorized access. 

5. Choices

We want to keep in touch with you in ways that you find to be beneficial. If you don't want us to use your contact information to communicate with you for promotional purposes (such as to tell you about other products and services that might be of interest or to offer coupons/discounts), please tell us that when you provide your contact information. If you decide at a later time you do not want to receive promotional communications, you can communicate this to us by accessing your account via our site (if applicable), by using our Opt-Out Link, or by following the instructions in the communications that we may send you. You can also communicate with us through the methods described in the "How to Contact Us" section below. Keep in mind that these preferences regarding promotional contacts do not mean that we might not contact you for other reasons, such as those related to an order you placed, an inquiry you made, a newsletter to which you may have subscribed, a membership you undertook, an event for which you registered, or a legally required notice.

6. California Privacy Rights

Beginning on January 1, 2020, California Civil Code Section 1798.100 permits customers of Lost Eden ("you") who are California residents:
    1) The right to know what personal information is being collected about you;
    2) The right to know whether your personal information is sold or disclosed and to whom;
    3) The right to Opt-Out of the sale of personal information;
    4) The right to access your personal information;
    5) The right to equal service and price after exercising your privacy rights.


You have the right to request the disclosure and/or deletion of your collected personal information. Such requests will be fulfilled upon the receipt of a verified request. A verified request will ask the customer to provide the information required to verify their identity including, but not limited to any three of the following: Name, Address, Previous Purchase, Email Address, or Payment Method.

As California residents, you have the right to request the disclosure of the following:
  • The categories of personal information collected;
  • The sources of personal information;
  • The business or commercial purpose of collecting;
  • The categories of third parties with whom Lost Eden shares personal information;
  • The specific personal information that was collected about you;
  • What categories of personal information that was sold (if any) and the category of third-party that it was sold to;
  • What category of personal information was disclosed for a business purpose.

Per the CCPA, at no point can we disclose your financial information or account password, even upon a verified disclosure request. We do not possess the personal information of minors.

If you cannot be verified, we can either treat your request as a request to Opt-Out, or we can contact you for more information to verify your identity. You should expect a confirmation email that your information has been deleted or disclosure of information within 45 days. Deletion includes permanent deletion, de-identification, or aggregation of the information. Any information stored on a back-up system or archive can be deleted whenever the system is next used.

Once the verifiable request is received, the consumer’s personal information will be deleted from the business records and we will direct our service providers to do the same from their records if applicable. Limitations and exceptions apply:
  • We may rightfully retain your personal information if it is collected;
  • To complete transactions for goods or services, perform contracts, or for anticipated ongoing relationships;
  • For the detection of protection from illegal activity or to assist prosecution;
  • To identify or repair errors;
  • For free speech or other rights provided by law;
  • For compliance with California Electronics Communications Privacy Act;
  • For compliance with the California Consumer Privacy Act;
  • For the engagement in statistical research in the public interest with consumer informed consent;
  • For internal uses based on consumer’s relationship with the business;
  • For legal obligation compliance;
  • For otherwise internal uses in a legal matter in context with the reason that consumer provided the information.

7. Is the data shared with other parties?

Lost Eden discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors, and affiliated organizations that need to know that information in order to process it on Lost Eden's behalf or to provide services available at Lost Eden's website, and that have agreed not to disclose it to others. Some of those employees, contractors, and affiliated organizations may be located outside of the United States; by using Lost Eden's website, you consent to the transfer of such information to them.

Your personal data or other information may be shared with and used by any of our other affiliated brands, for their direct marketing purposes, in accordance with this Privacy Policy.

In certain cases, we may disclose your personal data to third parties under limited circumstances if we conclude that we are required by law or have a good faith belief that access, preservation, or disclosure of such information is reasonably necessary to protect the rights, property, or safety of our winery, our customers, or the public. We do not sell your personal data to third parties.

We may also contract with other companies and individuals to perform certain functions and services, including processing, storing, tracking, and organizing information on our behalf. These third-party service providers may have access to your personal data to perform their functions and to provide services to us. We require our third-party service providers to maintain industry-appropriate security measures to protect your personal information.

In some cases, we may partner with other companies, affiliates, clients, data vendors, and third parties that we have carefully chosen to enhance your customer experience, usually through co-branded partnerships, promotions, and wine club experiences. In such cases, you may need to opt-in with those third-party partners to enable them to market their or other selected third parties’ products and services to you. You will have an opportunity to opt-out of those communications by unsubscribing from any third-party communications you do not wish to receive subject to those third parties’ privacy policies. We may also use non-personal data from these third parties pursuant to their own privacy policies.

We may aggregate your personal data so that the aggregated information does not personally identify you or anyone else. If we combine any non-personal information with personal information, the combined information will be treated by us as personal information as long as it is combined. We may collect, use, and disclose non-personal information for any purpose.

8. Google AdWords for remarketing

Losteden.com uses the remarketing services to advertise on third-party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven't completed a task on our site, for example using the contact form to make an inquiry. This could be in the form of an advertisement on the Google search results page or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone's past visits. Of course, any data collected will be used in accordance with our own privacy policy and Google's privacy policy.

You can set preferences for how Google advertises to you using the Google Ad Preferences page, and if you want to you can opt-out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

9. Facebook Analytics, Advertising, and Social Features

We use Facebook technologies to customize content and advertising, to provide social media features, and to analyze traffic to our website.

10. Privacy Policy Changes

Although most changes are likely to be minor, Lost Eden may change its Privacy Policy from time to time, and in Lost Eden's sole discretion. Lost Eden encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute your acceptance of such change.
